Grievance # M-25-06    Filed by the Local Committee on behalf of all IAM-M employees

Grievance filed due to:
When employees were placed on Temporary Modified Duty (TMD), the company maintained they had the  right to arbitrarily assign the employee to whichever shift and or days off they wanted to. Because of this, some employee’s had their work schedule changed by the company against their will, and were told should they not accept the offered  Temporary Modified Duty, they may loose insurance benefits.

Remedy sought by Union:  
To maintain that the employee, if offered TMD, be offered the TMD work on the same shift/days off that the employee currently maintains because of the employees right to hold that particular schedule was based on the rights of seniority accrued.

History of Grievance:
This grievance was filed by your local committee on behalf of all IAM-M covered members on December 18th, 2006. This grievance was denied @ all three steps of the grievance procedure and was appealed to the company for Arbitration process in October 2007.  Prior to being scheduled for arbitration, the company loosened it stance on this issue and District 142 and Hawaiian Airlines reached a settlement on this grievance:

Grievance Settlement: For Mechanics and Related Members (IAM-M)
In resolution of grievance M-25-06, the Company has agreed that when an employee covered by the IAM-M Agreement is released for Temporary Modified Duty, the work offered to the employee will conform to the employee’s regular work shift, which consists of the start and stop times and the days off of his/her shift. The company can continue to offer other times of TMD work that do not conform to the employees regular work shift, but it is understood that acceptance of those non-conforming times and days is strictly voluntary.
